The Portugal Citizenship can be acquired by those who were born before 1961 in the ancient Portuguese State of India, in accordance to Portuguese Nationality Law 37/81 and the relevant revisions of that law and all additional legislation on the subject.

Citizens born in the former Portuguese territories of Goa, Daman, Diu, Dadra, Nagar Haveli are Portuguese citizens, including their descendants (children, grandchildren, etc.). can apply for Portuguese citizenship if they meet any of the following requirements:

a) To have born in the former Portuguese territories of Goa, Daman, Diu, Dadra and Nagar Haveli during the portuguese sovereignty, ie, until 19 December 1961;
b) To be descendant to parents or grandfathers that were born in the territories listed above during the period of Portuguese sovereignty, even if the applicant was born in another country;
c) Must prove their residence in the period 1974 / 1975.
d) The rights of all who are born in the former Portuguese territories during the period of Portuguese sovereignty are guaranteed by the records of his birth in Portugal.
e) The record of this registries and other relevant facts are essential to accompany the application for Portuguese citizenship – the old documents.

Anyone can apply for registration of Portuguese citizenship on the basis of their birth during the period of Portuguese sovereignty, even after his death (their descendants up to their third generation).
In life, the applicant may submit the application in person. Otherwise, their descendants are entitled to submit the application on their behalf.

General Guidelines

GENERAL GUIDELINES

  • All the documents issued in English or any other local language will have to be duly translated in Portuguese and attested by all the local Authorities including Portuguese Consulate, within whose jurisdiction the document is issued or translated.
  • Documents of Birth proof in Goa, Daman & Diu are as under:-

1. Primary evidence: Birth Teor.
2. Secondary evidence: Birth Extract.
3. Tertiary evidence: Baptism Certificate.
However, the reason for non-availability is substantiate by certificate from Conservador do Registos Civil, certifying so.

Only Birth, Marriage and Death Teors issued in Goa, Daman & Diu (Estado da India) prior to 1969 are in Portuguese. The

rest of the Birth, Marriage and Death and any other relevant documents are issued in English.

  • Cases where the Birth Teors cannot be issued due to books of Birth Teors being destroyed reliance will be placed on Birth Extract and a Certificate from the Sub Registrar saying so will have to be obtained supported by Baptism Certificate. In suchcircumstances the following documents will be in addition:-

1. Birth Extract.
2. Certificate by the respective Conservador do Registo Civil of Destruction of books of Registo de Nascimento and hence Extract of Birth is issued.
3. Baptism Certificate.
Cases where the Birth Teor as well as Birth Extract cannot be issued due to books of Birth Teor and Birth Extracts being destroyed reliance will be placed on the Baptism Certificate. In such circumstances the following documents will be in addition:-
1. Certificate by the respective Conservador do Registo Civil of Destruction of books of Teor and Extract hence no Certificate of either Birth Teor or Extract can be issued.
2. Baptism Certifiate.
All Births and Marriages which have taken place within the jurisdiction of Portuguese Consulate, Goa but outside Goa, Daman & Diu will be supported by Parochial (Church) documents, duly attested by the local Authorities within which the Certificate is issued and the Portuguese Consulate, Goa.
All Births and Marriages which have taken place outside the state of Goa, Daman & Diu and out of the Portuguese Consulate, Goa jurisdiction will be supported by Parochial (Church) documents, duly attested by all the local Authorities within whose jurisdiction the Certificate is issued and the Portuguese Consulate, Delhi.
Birth /Marriage/Death certificates or any other documents issued by the Authorities out of the jurisdiction of Portuguese Consulate Delhi (i.e. outside India) are attested by the respective local Authorities within whose jurisdiction they are obtained and the Portuguese Consulate therein.
All faithful translations in Portuguese of the documents in other languages will be attested by the local Authorities where such translations are being done including the Portuguese Consulate.
It is our practice to encourage the clients to transcribe the Birth of the spouse/parent whose documents are in a Teor form rather than the ones whose Teors cannot be obtained. We prefer to transcribe the Birth, Marriage and Death of the deceased spouse/parent when the documents of the surviving spouse are defective.
Please be informed that the minimum time required for the process for Transcription of Birth and acquisition of Portuguese Nationality for Applicants born prior to 19th December 1961 is one year. And where the transcription of Birth and Marriage of parents is involved the minimum time is required is one and half year.

Note: In this case Birth Transcription will be done of the Applicant and the deceased Spouse as the same is required for the transcription of Marriage so as to bring the eligibility for the Children. (As per the new directions of the CRC the birth of both the Applicant and the deceased spouse is required to be transcribed at the CRC prior to the transcription of Marriage.

Note: In this case Birth Transcription will be done of the both the deceased parents as the same is required for the transcription of Marriage so as to bring the eligibility for the Children. (As per the new directions of the CRC the birth of both the deceased parents is required to be transcribed at the CRC prior to the transcription of Marriage).


BIRTH TEOR (Registo dear Nascimento):

Birth Teor is the certified Integral copy of the Birth Certificate photocopied from the Registo de Nascimento obtained from the office of the respective Conservatoria do Registo Civil/ Office of Civil Registrar cum Sub-Registrar.
Most of the Birth Registers/ Registos dear Nascimento from most of the Conservatoria do Registos Civil / Office of Civil Rgistrar cun Sub-Registrar have been shifted to the Directorate of Archives & Archaeology, Panjim - Goa under the direction of the High Court.
The Birth Certificates where the births have taken place after 1970 must be applied with the respective Municipal Council or Village Panchayat.

MARRIAGE TEOR (Registo dear Casamento):

Marriage Teor is the certified Integral copy of the Marriage Certificate photocopied from the Registo de Casamento obtained from the office of the respective Conservatoria do Registo Civil.
Most of the Marriage Registers / Registos dear Casamento from most of the Conservatoria do Registo Civil / Office of Civil Registrar cum Sub-Registrar have been shifted to the the Directorate of Archives & Archaeology, Panjim - Goa under the direction of the High Court.


DEATH TEOR (Registo dear Obito):

Death Teor is the certified Integral copy of the Death Certificate photocopied from the Registo de Obito obtained from the Office of the respective Conservatoria do Registo Civil / Office of Civil Registrar cum Sub-Registrar.
Most of the Death Registers / Registos dear Obito from most of the Conservatoria do Registo Civil / Office of Civil Registrar cum Sub-Registrar have been shifted to the the Directorate of Archives & Archaeology, Panjim - Goa under the direction of the High Court.
The Death certificates where the deaths have taken place after 1970 must be applied with the respective Municipal Council or the Village Panchayat.


RESIDENCE / DOMICILITY CERTIFICATE:

 Residence / Domicility Certificate is obtained from the respective Mamlatdar / Municipality / Panchayat within whose jurisdiction the applicant resides specifying the period and address of residence of the applicant. (The clause including the period from 1st January 1974 to 31st December 1975 must be mentioned where ever applicable). The Residence / Domicility Certificate is required so as to decide the jurisdiction of the Portuguese Consulate.


COMPLIMENTARY CERTIFICATE:

Complimentary Certificate is the complimentary proof of residence for the period between 1st January 1974 to 31st December 1975 to be obtained from Church / School / Work place clearly specifying the residential period and address which must compulsorily cover the period of residence between 1st January 1974 to 31st December 1975.


POLICE CLEARANCE CERTIFICATE:

Every applicant is required to produce Police Clearance Certificate of Good Moral Conduct having no adverse notice nor involved in any criminal cases with photo identity and 6 months validity issued by the respective Crime Investigation Department (C I D).


INDIAN PASSPORT:

Indian Passport is used as a recognized documents of Identification and therefore all the personal details such as the Name of the Applicant, Fathers Name, Mothers Name, Place of Birth, Date of Birth on the Indian Passport must match the Birth Teor (Registo de Nascimento). The name of the Spouse on the Indian Passport of the Applicant must always be the maiden name.
Ant error in the personal details on the Indian Passport must be corrected by the way of endorsement on the existing Passport or by obtaining a fresh Passport.
No Divergence, Rectification, Regularization, Affidavits or Declarations before any authority in India justifying the errors are acceptable.
